Collection of personal data
The types of personal data that we collect when you use our website are explained below. Data are personal if they can be uniquely attributed to a specific person, e.g. name, address, e mail addresses, user behaviour.

Whenever you contact us, we retain the data provided by you (your name, and your e mail address and telephone number where applicable) and the data transferred (which may include personal data) for the purpose of contacting you and handling your request. The retention periods that apply are the same as those that apply to written documents. The legal basis for the processing of your personal data is Article 6(1)(e) GDPR in conjunction with Section 3 of the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG). We need to process the personal data you transfer to us in order to make contact with you and handle your request.
Usage analysis
Whenever a user accesses the website about the protection of cultural property operated by the Federal Government Commissioner for Culture and the Media and whenever a file is retrieved, data are stored in a log file on our web servers for a limited period, and may be used for identification purposes where this is necessary in the interests of technical security, in particular with a view to averting attempted attacks. This includes the following data:
· IP address;
· date and time of retrieval (time stamp);
· request details and destination address (protocol version, HTTP method, referrer, user-agent string);
· name of the retrieved file and volume of data transferred (requested URL including query string, size in bytes);
· message indicting whether the retrieval was successful (HTTP status code).
Log files are stored for 30 days
The stored data are also evaluated in anonymized form for statistical purposes. We will use the data for different purposes or transfer it to third parties only if we are obliged to do so by law.
In the event of major violations of our terms and conditions of use, or in the event of unlawful access or attempts at unlawful access to our servers, we reserve the right to use individual data records to trace additional personal data.
Use of cookies
Cookies are used in certain areas of our website to make navigation easier (“session ID” cookies) or to balance the load on our web servers. These session cookies do not contain personal data and expire at the end of the session. We do not use add-ins such as Java applets or ActiveX controls that allow users’ access patterns to be tracked.
The specific cookies used are as follows:

The European Commission has published an English-language website with information on this topic, which stipulates that cookies of this kind (i.e. that make it possible to deliver the website from a technical point of view) are exempt from the restrictions imposed by data protection law:

Most browsers are configured to accept cookies automatically, but you can disable the storage of cookies or configure your browser to alert you each time cookies are sent. This might mean, however, that use of our website is subject to certain technical restrictions.
Statistical investigations
We use the Matomo (previously PIWIK) web analytics service on our website. Matomo is an open-source software solution aimed at website optimization, which runs exclusively on the servers of our web provider (ITZBund) on behalf of the Federal Government Commissioner for Culture and the Media. No cookies will be placed on your computer for the purpose of web analytics.
If you access individual pages of our website, the following data will be stored on our website’s servers:
· two bytes containing the IP address of the user system retrieving the page (anonymous);
· the page that has been retrieved;
· the website from which the user accessed the retrieved page (referrer);
· the subpages that are accessed from the accessed website;
· the time spent on the page;
· how often the page has been retrieved.
Web analytics are used for the sole purpose of optimizing our website. Data are not used for non-anonymous analysis or profiling, and are not transferred to third parties. In this context, anonymization of the IP address ensures that due account is taken of the user’s interest in the protection of the personal data.
If you do not consent to this fully anonymized storage and evaluation of the data as described above, you can object to the storage and use of the data at any time. If you do so, an opt-out cookie will be stored in your browser, and Matomo will no longer collect session data.
As soon as you activate the option “I do not want to be tracked” in your browser, Matomo will collect no further data from you, and there is no need for you to do anything else. If you have not yet activated this option, you can do so by following the instructions provided at the bottom of this page.
If you use Internet Explorer, you will need to complete the following steps to deactivate Matomo: navigate to TOOLS → INTERNET OPTIONS → PRIVACY → ADVANCED, place a check mark next to “Override automatic cookie handling” and confirm by clicking on “OK”.
Note: If you clear your cookies, the opt-out cookie will also be deleted, and you may therefore need to reactivate it.
Ordering printed documents
If you order brochures, leaflets and other printed documents from our website, we will require the following personal data to process your order:
• surname, first name;
• street, house number;
• postcode and town/city;
• e mail address.
If we are unable to process the order in its entirety, the data you have provided will be forwarded to third parties (such as a shipping company or any other authorities or institutions responsible for sending out the documents you have ordered). The legal basis for the processing of your data will be your consent pursuant to Article 6(1)(a) GDPR. It will not be possible to process your order if you have not provided these data.
The data you provide will be deleted 90 days after your order has been processed.
Protection of minors
If you are under 18 years of age, please do not send us any personal data without the consent of your parent or guardian. We do not request personal data from children or juveniles, nor do we knowingly collect such data or transfer them to third parties.
Use of downloadable forms
If you use the downloadable forms provided on our website, the Land to which the relevant completed form is to be sent is responsible for data protection and the related compliance measures. The privacy policy of this Land will apply on a mutatis mutandis basis. The Federal Government Commissioner for Culture and the Media merely provides downloadable versions of the forms, and has no access to any personal data you may enter when completing them.
If you wish to exercise your right to lodge a complaint with a data protection supervisory authority pursuant to Article 77 GDPR, the authorities of the Land in question will be responsible for handling your complaint in such cases. The contact details for these authorities are listed below.
Your rights
You can exercise the following rights against us in respect of your personal data:
• the right of access (Article 15 GDPR);
• the right to rectification (Article 16 GDPR);
• the right to erasure (the “right to be forgotten”, Article 17 GDPR);
• the right to restriction of processing (Article 18 GDPR);
• the right to object (Article 21 GDPR);
• the right to data portability (Article 20 GDPR).
If your personal data are processed on the basis of your consent, you are entitled to withdraw this consent at any time. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal (Article 7(3) GDPR).
You also have the right to lodge a complaint with a data protection supervisory authority about the processing of your personal data by us or by the competent Land (Article 77 GDPR). The competent supervisory authorities are as follows:
